Caribious is gevestigd op Bonaire (Caribisch Nederland). Op de verwerking van persoonsgegevens is daarom in beginsel de Wet bescherming persoonsgegevens BES (Wbp BES) van toepassing, met de Commissie toezicht bescherming persoonsgegevens BES (CBP BES) als toezichthouder.
Daarnaast verwerken wij persoonsgegevens van personen die zich in de Europese Unie bevinden — bijvoorbeeld bezoekers en gasten die vanuit de EU een boeking plaatsen. Voor die verwerkingen is ook de Algemene Verordening Gegevensbescherming (AVG/GDPR) van toepassing op grond van haar territoriale werking. Wij hanteren in de praktijk het beschermingsniveau van de AVG, omdat dit het meest verstrekkende kader is en de verwerkingen van EU-betrokkenen afdekt.
Caribious treedt op als tussenpersoon (onmiddellijk vertegenwoordiger) tussen de aanbieder van een tour of activiteit (de vendor) en de consument. Onze rol verschilt per soort gegevens:

Voor zover gegevens worden doorgegeven naar landen buiten de EU/EER waarvoor geen adequaatheidsbesluit geldt, gebeurt dit op basis van passende waarborgen, zoals de modelcontractbepalingen (Standard Contractual Clauses) van de Europese Commissie.
Wij nemen passende technische en organisatorische maatregelen om uw gegevens te beschermen tegen verlies of onrechtmatige verwerking. Hieronder vallen onder meer versleutelde verbindingen, gescheiden toegang via een beveiligde server-endpoint, afgeschermde beheerderstoegang en periodieke rotatie van toegangssleutels. Volledige kaartgegevens worden uitsluitend in een gecertificeerde betaalomgeving verwerkt en niet door Caribious opgeslagen.
Caribious gebruikt cookies en vergelijkbare technieken. Strikt noodzakelijke cookies plaatsen wij zonder toestemming, omdat de website zonder deze niet goed werkt. Bij een inbreuk in verband met persoonsgegevens handelen wij conform de toepasselijke meldplicht. Voor verwerkingen onder de AVG melden wij een meldingsplichtig datalek waar vereist binnen 72 uur aan de bevoegde toezichthouder, en informeren wij betrokkenen indien de inbreuk een hoog risico voor hen oplevert. Caribious is established on Bonaire (Caribbean Netherlands). The processing of personal data is therefore in principle subject to the Personal Data Protection Act BES (Wbp BES), with the BES Personal Data Protection Supervisory Commission (CBP BES) as supervisory authority.
In addition, we process personal data of individuals located in the European Union — for example visitors and guests who make a booking from the EU. For those processing activities the General Data Protection Regulation (GDPR) also applies by virtue of its territorial scope. In practice we apply the GDPR level of protection, as it is the most far-reaching framework and covers the processing of EU data subjects.
Caribious acts as an intermediary (direct representative) between the provider of a tour or activity (the vendor) and the consumer. Our role differs depending on the type of data:

We take appropriate technical and organisational measures to protect your data against loss or unlawful processing. These include encrypted connections, segregated access via a secured server endpoint, restricted administrator access and periodic rotation of access keys. Full card details are processed exclusively in a certified payment environment and are not stored by Caribious.

In the event of a personal data breach, we act in accordance with the applicable notification obligation. For processing under the GDPR, where required we report a notifiable data breach to the competent supervisory authority within 72 hours, and we inform data subjects if the breach poses a high risk to them.
