In short. Caribious acts solely as an intermediary between the provider of a tour, ticket or service and the consumer. The purchase agreement is entered into between the provider and the consumer; Caribious is not a party to it. These terms govern all offers, bookings and agreements for products sold via the Caribious platform.

Article 1 · Definitions

In these General Terms and Conditions the following definitions apply:

CaribiousCaribious B.V., registered in the Bonaire Chamber of Commerce under nr. 9796, with its registered office and principal place of business in Bonaire at Kaya Berilo 38.
ProductAny tour, ticket and/or service, offered for sale by the booking widget of Caribious on behalf of the provider of such tour, ticket and/or service.
ConsumerHe/she who purchases (or wants to purchase) a product via the booking widget of Caribious.
UserThe consumer and any person designated by the consumer who will make use of the product(s) purchased by the consumer.
ProviderThe provider (or his/her representative other than Caribious) of a product offered for sale via the Caribious booking widget.
Purchase priceThe purchase price of a product.
ResourcesAll information, resources, services, products and tools provided via the Caribious website caribious.com.
Purchase AgreementThe agreement between the provider and the consumer for a product offered for sale by Caribious.
Service AgreementThe agreement between Caribious and the provider for selling a product on behalf of the provider by Caribious.
Written / in writingOn paper and/or via e-mail or other electronic communication.

Article 2 · Application

  1. These General Terms and Conditions apply to all offers, bookings, agreements and performed services relating to all products sold via the Caribious platform. Different terms and conditions, stipulations, arrangements and/or undertakings do not apply unless explicitly confirmed in writing by Caribious.
  2. Caribious reserves the right to alter the General Terms and Conditions unilaterally. In case of an alteration, Caribious will promptly notify the parties concerned in writing.

Article 3 · Nature of Purchase Agreement

  1. Caribious acts as an intermediary between provider and consumer for the conclusion of a purchase agreement and is explicitly no party to the purchase agreement. A purchase agreement is entered into by the provider and the consumer.
  2. Caribious has been authorized by the provider to act on its behalf regarding the sale and payment of its product(s).
  3. The purchase agreement between provider and consumer concerns the supply of one or more products.

Article 4 · Offers, prices and rates

  1. All offers, promotions, prices and rates by Caribious on websites, social media and/or brochures of any kind are not binding and subject to acceptance by consumer. Caribious is not bound by any omission or error in its communication and/or publicity.
  2. Price quotations are subject to change until a reservation is confirmed by Caribious.
  3. All prices mentioned are in US Dollar and are inclusive of ABB.
  4. All prices mentioned are per person, unless explicitly mentioned otherwise.
  5. Tips/gratuities, baggage and/or personal insurance, beverages and/or food not described in the product's description and all other purchases of a personal nature are not included.

Article 5 · Product purchases

  1. A purchase only becomes valid after confirmation in writing by Caribious.
  2. Product purchases can only be made by persons older than eighteen (18) years.
  3. All confirmed product purchases are permanent and binding, meaning that in case of cancellation the terms and conditions as set out in article 7 apply.

Article 6 · Payment

  1. All products must be paid upon confirmation of the product purchase, unless explicitly mentioned otherwise.
  2. Payments should always be made to Caribious via the payment methods provided by Caribious.
  3. The date that a payment is received by Caribious is considered to be the date of payment.

Article 7 · Cancellation, substitution and change by consumer

  1. Consumer is at any time allowed to cancel the product purchase or to appoint a substitute consumer under the condition that provider explicitly agrees with the substitution.
  2. In case of substitution of consumer, the substitute consumer and the original consumer are jointly and severally responsible for payment of the remaining amount due to Caribious.
  3. In case of cancellation of a product purchase, consumer is required to make payment of:
    Cancellation moment before supplyAmount due
    Between sixty (60) and fifteen (15) days before25% of the purchase price
    Between fourteen (14) and eight (8) days before50% of the purchase price
    Within seven (7) days before100% of the purchase price
    or different terms and conditions when explicitly mentioned on the provider's website.
  4. Consumer is allowed to request changes to the product purchase. A request for change must be made in writing to Caribious or to the provider and is subject to availability with the provider. A requested change only becomes valid after written confirmation by Caribious or by the provider.
  5. No refund will be given for any products or parts of products unused by consumer, regardless of circumstances.
  6. In the event that the provider applies its own cancellation conditions for a specific product, such provider cancellation conditions shall prevail over the cancellation conditions set out in this article 7. In such case, Caribious shall apply and enforce the provider's cancellation conditions, and the cancellation conditions of Caribious shall not apply.

Article 8 · Cancellation and change by Caribious

  1. Caribious (as intermediary) may cancel or alter the purchase agreement between provider and consumer at any time in the event of force majeure, which includes but is not limited to situations of war, strike, natural disaster, extreme weather conditions, fire, or death of the provider.
  2. Caribious is not liable for any other damages and/or costs due to cancellation or change of the purchase agreement.

Article 9 · Caribious voucher

  1. After confirmation of purchase and payment for a product, consumer will receive a unique voucher for each product, which will be provided via a secure webpage hosted by Caribious.
  2. Consumer must provide this unique voucher to the provider in order to redeem the product.
  3. To validate the voucher, consumer may be required to present a valid photo ID and/or the credit or debit card used to purchase the product.
  4. If no voucher is provided or no valid photo ID, credit card or debit card is presented upon request, provider may refuse to provide the product to consumer. In such case consumer is not entitled to another product or to any refund.

Article 10 · Liability

  1. Caribious acts as an intermediary between provider and consumer and therefore cannot be held liable in the event a provider and/or consumer fails to meet their obligations under the purchase agreement.
  2. Caribious is not liable for damages due to omissions and/or errors in offers, promotions, prices and rates from Caribious on websites, social media and/or brochures of any kind, as well as in reservation confirmations and/or purchase agreements.
  3. Caribious is not liable for damages incurred by consumers, users and/or providers due to any cause related to the use and/or supply of a product.
  4. Caribious is not responsible in case of loss, theft or damage to consumer's or other users' property.
  5. Caribious is not responsible in case of loss, theft or damage to provider's property.
  6. Caribious is not responsible for damages and/or inconvenience caused by force majeure or by third parties.
  7. Consumer and users designated by consumer are jointly and severally liable for any damages incurred due to negligence or non-compliance with obligations under the purchase agreement, including obligations mentioned in these General Terms and Conditions.

Article 11 · Data Protection and Privacy

  1. In the performance of its services, Caribious processes personal data of consumers and users exclusively for the purpose of facilitating bookings, payments, voucher issuance, customer support, and compliance with applicable legal and administrative obligations.
  2. With respect to personal data relating to consumers purchasing products of a provider, such data remains the property and responsibility of the provider. Caribious shall not acquire any ownership rights in such data.
  3. Caribious shall process personal data either as a processor on behalf of the provider or, where applicable, as an independent controller for its own platform-related processing activities, all in accordance with applicable data protection legislation, including the General Data Protection Regulation (GDPR/AVG).
  4. Personal data processed by Caribious shall not be used for marketing, commercial solicitation, profiling, data enrichment, or any other purpose beyond the scope described in paragraph 1 of this article, unless explicitly agreed in writing with the provider and/or the data subject.
  5. Caribious shall not share personal data with third parties, including affiliated or group companies, except where necessary for the execution of the services, required by law, or explicitly agreed in writing.
  6. Personal data shall be retained no longer than necessary for the purposes for which it was collected, subject to applicable statutory retention obligations. Upon termination of the service relationship, personal data that is no longer required shall be deleted or irreversibly anonymized.
  7. Caribious maintains appropriate technical and organizational measures to protect personal data against loss, unauthorized access, or unlawful processing.
  8. Further details regarding the processing of personal data are set out in the Caribious Privacy Policy, which forms an integral part of these General Terms and Conditions. Where required, a separate data processing agreement (DPA) may be concluded between Caribious and the provider.

Article 12 · Jurisdiction

  1. The agreements between provider and consumer and between Caribious and provider, as well as the services provided by Caribious are governed by the laws of Bonaire.
  2. The competent court in Bonaire has exclusive jurisdiction over any disputes arising in connection with these General Terms and Conditions, the purchase agreement, the services provided by Caribious or any agreements between parties.
